Intricate Audio Inc. (“Intricate Audio,” “we,” “us” or “our”) is an audio equipment sales and services business based in Ontario, Canada. We operate https://intricateaudio.com and provide audio products, custom audio and installation services, DJ and event production, professional audio, lighting and video services, and equipment rentals.

This Privacy Policy explains how we collect, use, disclose, retain and protect personal information when you visit our website, purchase products, request information or a quote, arrange services or rentals, make a booking, submit a review, or communicate with us. These activities are collectively referred to as our “Services.”

Our online store is hosted by Shopify. Shopify and other service providers process information as described below.

If this Privacy Policy conflicts with our Terms of Service concerning the collection, use or disclosure of personal information, this Privacy Policy governs that issue, subject to applicable law. Visiting our website or accepting purchase terms does not, by itself, constitute consent to optional marketing or enrolment in our SMS program.

1. Personal information we collect

Personal information means information that identifies you or can reasonably be linked to you. It does not include information that has been anonymized so that it cannot reasonably identify you.

Depending on how you interact with our Services, we may collect or process:

  • Contact information, including your name, email address, telephone number, billing address and shipping address.
  • Account information, including account identifiers, preferences, settings and authentication information processed through Shopify or another account provider.
  • Transaction information, including products you view, add to your cart, purchase, return or exchange; order history; payment status; and shipping, delivery and pickup details.
  • Service and booking information, including requested quotes, installation requirements, vehicle make and model, equipment specifications, rental arrangements, event details, venue information and scheduling preferences.
  • Payment-related information, including transaction identifiers, payment confirmations and limited payment details provided by payment or financing providers. Those providers process the financial information necessary to authorize payments or assess financing requests under their own applicable terms and privacy notices.
  • Communication information, including enquiries, emails, text messages, attachments, support records, call or voicemail information, and records of consent or withdrawal.
  • Review information, including reviews, ratings, photographs and other material you choose to submit for public display.
  • Device and usage information, including your IP address, approximate location inferred from it, browser and device information, identifiers, referring pages, and information about how you interact with our website.

Please do not send full payment-card details, account passwords, government identification documents or unrelated sensitive information through our contact form, email or text messages.

2. Where information comes from

We collect personal information:

  • Directly from you when you browse, create an account, place an order, request a quote, arrange a service or booking, submit a review, or communicate with us.
  • Automatically through our website, Shopify and integrated technologies, including cookies and similar technologies, subject to applicable consent requirements.
  • From service providers involved in payments, financing, shipping, communications, reviews, analytics, accounting and other business functions.
  • From an authorized representative or another person arranging a purchase, delivery or booking on your behalf.

If you provide another person’s information, please provide only what is necessary and ensure you have appropriate authority to do so.

3. How we use personal information

We use personal information for purposes reasonably connected to our Services, including to:

  • Process payments, fulfil orders, arrange shipping or pickups, and handle returns or warranty enquiries.
  • Respond to enquiries, assess product compatibility, prepare requested quotes and provide customer support.
  • Coordinate installations, custom work, rentals, services and event bookings.
  • Maintain customer accounts and remember preferences.
  • Send relevant account, order, delivery, service and booking communications.
  • Display and administer reviews submitted for publication.
  • Operate, personalize, evaluate and improve our website and Services.
  • Detect fraud, prevent misuse, protect accounts and maintain security.
  • Maintain business, tax and accounting records.
  • Comply with applicable law, respond to lawful requests, resolve disputes and establish or defend legal rights.
  • Conduct marketing or advertising where permitted by law and consistent with applicable consent and privacy choices.

Our customer-service SMS program does not enrol you in promotional text campaigns. Any promotional SMS program would require its own appropriate consent and disclosures.

4. Consent and communication choices

We explain the purposes for collecting personal information at or before collection, or otherwise as required by law. We obtain consent where required, including separate consent for optional communications or other uses that require an affirmative choice.

Providing information necessary for an order, enquiry or booking does not automatically subscribe you to marketing or authorize unrelated uses.

You may withdraw optional consent through the applicable unsubscribe method or by contacting us. Withdrawal does not affect processing already lawfully completed or information we must retain for legal obligations, an unresolved transaction or another permitted purpose.

If you decline information necessary to provide a requested service, we may be unable to provide that service. We will explain the consequence.

You can unsubscribe from promotional emails through the unsubscribe link in those emails. We may continue to send necessary non-promotional communications concerning an existing order, account or booking.

5. Text messages and SMS consent

The Intricate Audio Customer Service SMS program provides customer-service and transactional SMS/MMS about enquiries, requested quotes, orders, shipping and delivery, pickups, installations, services, rentals and event bookings.

Messages may be sent manually or automatically. Message frequency varies according to your interactions with us. Message and data rates may apply according to your mobile carrier’s plan.

Participation is optional. SMS consent is not a condition of purchasing products, booking services or submitting an enquiry.

We obtain and document consent through the enrolment method presented to you. Website enrolment requires actively selecting a separate optional checkbox that is not checked in advance. Providing a telephone number alone does not enrol you in the program.

We retain information necessary to demonstrate consent and respect your choices, such as your mobile number, affirmative response, consent wording and version, source of consent, relevant dates and submission records.

If you initiate a text conversation, we may respond to your enquiry within that conversation as permitted by law. An incoming enquiry does not authorize unrelated promotional messages or enrolment in another campaign.

Consent applies to Intricate Audio and the message purposes disclosed to you. It does not authorize another business or brand to contact you.

Mobile information, SMS opt-in information and consent records will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes. Messaging providers, technical service providers and carriers may process the information necessary to deliver, secure and support the program, subject to appropriate restrictions. This exception does not authorize their independent marketing use of your SMS consent.

Reply STOP to withdraw consent to program texts. We may send one confirmation of your opt-out. You may also withdraw consent by emailing sales@intricateaudio.com.

6. Shopify and service providers

Our store is hosted by Shopify. Shopify collects and processes personal information when you visit and purchase from our store to operate and improve the storefront, checkout, payments, accounts and related services.

Where Shopify Network Intelligence and its enhanced services are enabled, Shopify may also process information from your interactions with our store together with information from your interactions with other merchants and Shopify. These services support security, personalization, business improvement and advertising features.

For certain processing activities, Shopify is responsible for responding to privacy requests concerning its own use of personal information.

Information submitted through our Services may be transmitted to Shopify and other providers located outside your country.

We also use providers for payments or financing, shipping and fulfilment, product reviews, customer communications, marketing where authorized, accounting, data management, analytics and business automation. Examples of integrated services include Quo for communications, Klaviyo for marketing tools, and Judge.me for reviews. Their access depends on the services they perform and how they are configured.

Providers acting on our instructions are authorized to process information for the relevant service and must protect it appropriately. Some providers, including financing providers you choose and Shopify for certain services, also process information for their own purposes under their own privacy notices.

7. Other disclosures

We may disclose relevant personal information:

  • To suppliers, warehouses, delivery providers, technicians and event partners as necessary to fulfil your requested order or service.
  • To analytics and advertising providers where enabled, lawful and consistent with applicable privacy choices.
  • To professional advisers assisting with legal, accounting, insurance or business matters.
  • When you request or authorize a disclosure.
  • To comply with applicable law, lawful legal process or government requests, or to investigate fraud and protect safety or legal rights.
  • In connection with a proposed or completed merger, acquisition, financing, sale or reorganization, where permitted by law and subject to appropriate confidentiality and purpose restrictions.

The SMS-specific restrictions in Section 5 govern SMS opt-in information and consent records notwithstanding any broader disclosure language elsewhere in this policy. A business transaction does not itself authorize transferring SMS consent to unrelated marketing campaigns.

8. Cookies, analytics and advertising choices

Shopify and integrated technologies use cookies and similar tools for functions such as account access, checkout, security, remembering preferences and maintaining your cart.

Depending on enabled features and your choices, non-essential technologies may also support analytics, personalization and advertising. Where applicable law requires prior consent, those technologies require that consent.

You can manage choices through the cookie or privacy controls available on our storefront. Your browser may also allow you to block or delete cookies, although blocking essential cookies can affect website functions.

Some advertising-related disclosures, including certain Shopify enhanced services, may constitute a “sale,” “sharing” or processing for “targeted advertising” under applicable US state privacy laws, even when no money is exchanged.

Where required by applicable law, we honour recognized opt-out preference signals, including Global Privacy Control, through the applicable Shopify or integrated privacy controls. The scope of an opt-out may depend on whether the request can be associated with your device, browser or account.

Other browser “Do Not Track” signals do not necessarily have the same legal or technical effect.

9. Calls, reviews and business automation

If calls are recorded or transcribed, we provide notice or obtain consent where required by applicable law.

We may use automation or AI-assisted tools to route enquiries, summarize communications, organize records and support customer service or fulfilment. Information processed for these purposes remains subject to this policy and appropriate provider restrictions.

Reviews and other content you submit for public display may appear with the name and other information identified when you submit them. Please avoid including sensitive information or another person’s private information in public reviews.

Submitting a public review does not authorize us to publish your private support communications.

10. International processing

Shopify and other providers may store or process personal information in Canada, the United States or other countries. Information may be subject to the laws of those countries and lawful access by their courts, regulators or government authorities.

We remain accountable for personal information under our control and use contractual or other appropriate measures for providers acting on our behalf.

Where applicable law requires safeguards for international transfers, we use the applicable lawful transfer mechanism, such as an adequacy decision or recognized contractual safeguards, as appropriate to the transfer.

11. Retention and security

We retain personal information for as long as reasonably necessary for the purpose for which it was collected, including to provide Services, complete transactions, resolve disputes, meet legal or accounting obligations, demonstrate consent and honour communication preferences.

Retention periods depend on the information involved, the status of the relationship and applicable requirements. Minimal consent or suppression records may need to remain after an opt-out so that we do not contact you again without a valid basis.

When identifiable information is no longer needed and may lawfully be removed, we delete it or de-identify it.

We apply administrative, technical and physical safeguards appropriate to the information’s sensitivity and restrict access to authorized people and providers. No system or transmission method can be guaranteed completely secure.

If a privacy or security incident occurs, we assess it and provide notifications where required by law.

12. Your privacy rights

Depending on where you live and which laws apply, you may have rights to:

  • Request information about our collection, use and disclosure of your personal information.
  • Access or obtain a copy of your information.
  • Correct inaccurate or incomplete information.
  • Request deletion.
  • Withdraw consent.
  • Opt out of certain sales, sharing or targeted advertising.

These rights may be subject to exceptions, including information needed for legal obligations, an outstanding transaction or the rights of another person.

We may verify your identity or an agent’s authority using proportionate information. Do not email sensitive identification documents unless we have arranged an appropriate verification method.

We respond within applicable legal timelines. For access requests under Canadian PIPEDA, the usual response period is 30 days from receipt, subject to permitted extensions. We provide required notices concerning extensions or refusals.

We do not discriminate against you for exercising an applicable privacy right.

14. Children’s information

Our website and communications are not directed to children under 13. We do not knowingly collect their personal information for marketing.

A parent or guardian should contact us if a child has provided personal information that should be removed. Customers must have the legal capacity or appropriate authorization to make a purchase or booking.

We do not knowingly sell or share the personal information of individuals under 16 for targeted advertising.

15. External websites

Our Services may link to manufacturers, financing services, review platforms, social media or other independent websites. Their collection and use of personal information are governed by their own privacy notices.

Review those notices before providing information. Information you post publicly on a third-party platform may be visible to others according to that platform’s settings and rules.

16. Changes to this policy

We may update this Privacy Policy to reflect changes in our practices, Services or legal requirements. We will update the “Last updated” date and provide additional notice where required.

Where a new use requires fresh consent, we obtain that consent. Updating this policy does not itself create marketing consent or expand an existing SMS opt-in.
